1.1. MITSUBISHI ELECTRIC EUROPE, B.V., is the organisation responsible for your personal information, together with other members of the group (referred to henceforth as MEU). MEU is committed to safeguarding the privacy of clients and users (referred to henceforth as user(s)) who visit their websites (referred to henceforth as Websites). This privacy policy (referred to henceforth as Privacy policy) establishes the way in which personal information on the Websites is collected and shared in order to make the user aware of the ways in which the Websites collect personal information, as well as how this information is used and shared with MEU.

If you access a third party website via one of these links, remember that these links contain their own privacy policies, and MEU accepts no responsibility for their processing of personal information. 2. User information which may be collected

2.1 All or part of the following personal information will be collected and processed:

(a) Information provided by the user

The personal information provided by the user includes the details entered on the Websites’ contact forms, for example, name, surname, email address, telephone number and other contact details. Likewise, when users purchase MEU products or contract their services, it is possible that, on certain occasions, the user may need and request an MEU technical support service relating to these products and services. In this case, MEU will collect your contact details to be able to attend to your technical support request, as well as any other details which may be necessary to assist you.

(b) Correspondence

When you contact MEU, a record of your correspondence is normally recorded, including any personal information provided by the user.

(c) Survey information

It is possible that users may be asked to complete surveys for research purposes, where it is optional for them to provide their details or not. In these circumstances, the information provided in the final survey will be collected.

(d) Websites and media usage

When a user visits the Websites, details and information will be collected about these visits via cookies and other similar technology. This information includes your IP address and domain name, the browser version, the operating system, traffic and location details, website records, resources accessed and other communication data.

3. Use of personal information

3.1 This section sets out the purposes for which the Websites’ user’s personal information is collected and, in accordance with European legislative regulations, the legal grounds which justify MEU’s processing of information.

3.2 These legal grounds are set out within the European Regulations on Data Protection. Data protection rules only allow personal information to be processed by the management team when one or more of the legal grounds specified in the regulations occur (you can view the details of these grounds here).

3.3 Remember that, as well as the following disclosures, personal information may be shared with providers, contractors, agents, advisers (legal, financial, sales or otherwise), MEU subsidiaries acting in the name of Mitsubishi Electric, B.V., Spain Branch and other members of the Mitsubishi Electric group, for the purposes outlined in this Privacy policy.

(a) For the purposes of effective communication and business transactions

The users’ personal details are used for business transactions, which include replying to user queries and requests, contacting users to offer information relating to our products and services, attending to technical service requests or fulfilling responsibilities arising from the contracts between users and MEU.

The use of users’ personal information for the aforementioned purposes, meets the need of and is justified by the execution of a contract and the legitimate interest of MEU of being able to carry out their responsibilities and offer you their services.

(b) To offer you marketing material

Only when the Website users have accepted it, their personal details will be used for the purpose of forwarding communication relating to the products and services of MEU and its selected business partners by post, email, SMS, telephone and fax. In the cases required by law, your consent will be requested at the time of your details being collected in order to implement any of these sales communication actions. Users have the option of cancelling their subscription or to stop receiving further sales communications related to the marketing of electronic products, or they have the option of contacting MEU to stop receiving the communications detailed in the form “RGPD: Contact” which follows.

The use of users’ details for the aforementioned purposes is justified by the explicit consent freely granted by the users to MEU to receive marketing communication, as well as MEU’s legitimate interest to offer you information about their products and services where and when the Website’s users have requested it and consented to it.

(c) For research and development purposes

The processing of the users’ personal details will be implemented in order to obtain information which will help us to gain a better understanding of the service and sales requirements of MEU users and clients, as well as to gain a better understanding of our business, develop higher quality products and services which satisfy our clients’ needs.

The use of the users’ details for the aforementioned purposes is justified by MEU's legitimate interest of improving its services.

(d) To supervise certain activities

The use of users’ personal details is carried out in order to supervise their queries and transactions with the aim of guaranteeing the quality of MEU’s products and services as well as guaranteeing the compliance of legal procedures and combating fraud.

Justification of usage:

The use of the users’ personal details for the aforementioned purposes is justified by the need to comply with legal responsibilities, legal claims and MEU's legitimate interest of guaranteeing quality and compliance with the law.

(e) To inform you of changes

MEU uses the users’ personal details in order to communicate and inform users of changes which may arise relating to our products and services.

Justification of usage:

The use of personal details to inform users about changes is justified on the basis of MEU’s legitimate interest to offer their users and clients information about changes which may arise relating to products which have been purchased from our company and guarantee that these products comply with our clients’ quality demands.

(f) To guarantee that the content of the Websites continues to be relevant

The users’ personal details are used by MEU to guarantee that the Websites’ content is presented in the most effective way for the user and the devices of the Mitsubishi Electric brand which they have purchased, including sharing information with our business partners, distributors or service providers.

The use of the users’ personal details to guarantee that the Websites’ content is relevant is justified on the basis of MEU’s legitimate interest of offering information to their users which they may need relating to products which have been purchased, as well as showing updated web content in accordance with MEU’s products and services.

In the case that MEU: (i) is involved in negotiations for the sale of the whole or a part of its business to third parties; (ii) selling the business to a third party; or (iii) carrying out a reorganisation of its business, it is possible that all or a part of the users’ personal information may be transferred to the third party (or to its advisers or assessors) as part of the due diligence processes as part of the analysis of any sale or proposed reorganisation. It is also possible that we may need to transfer the users’ personal information to this reorganised party or to a third party after the sale or reorganisation so that they can use it for the same purposes as set out in this policy.

The use of your personal details with regards to transferring them to a third party in the case of a partial or total sale of the MEU business is justified by our legitimate interest to change, reorganise or restructure our business.

(h) With regards to legal responsibilities or regulations

It is possible that the users’ personal details are used by MEU for the fulfilment of legal responsibilities or responsibilities related to regulators, which includes revealing personal information to third parties such as legal services, administrative regulatory bodies, Law Enforcement Bodies related to pleas, proceedings or investigations carried out by these entities. Where permitted, you will be advised about such requests or you will be informed, before giving a response, unless, in doing so, it would interfere with the prevention or detection of an illicit activity.

The use of the users’ personal details in accordance with the aforementioned purposes is justified on the basis of the compliance of legal responsibilities and claims and MEU’s legitimate interest in collaborating with administrative, legal and security control organisations.

4. Sharing, storage and protection of personal information

Internet Security

4.1 The security of Internet or Website transfers cannot be guaranteed against intrusions. However, reasonable physical, electronic and procedural mechanisms are employed to protect the user’s information in accordance with the requirements set out in the data protection legislation.

4.2 All the information provided to us is stored on our secure servers or in those of our subcontractors. Access and use of this information are subject to MEU's policies and security standards. If you receive (or choose) a password which enables you to access certain parts of the Websites, you have the responsibility to keep this password confidential and comply with the security procedures indicated. We ask you not to share your passwords with anyone.

Exporting outside of the EEA

4.3 MEU personnel or providers can access the user’s personal information, share it or store it at locations outside of the European Economic Area (“Third Countries”) where these personnel or providers may be based. The data protection laws outside of the European Economic Area may be less restrictive, but under any circumstances, your personal details are protected in accordance with the terms set out within this Privacy policy.

4.4 When personal information is transferred from countries within the European Economic Area (EEA) to other countries, it is possible that additional measures should be taken to protect the relevant personal information. The European Commission has recognised the regulations of certain countries outside of the EEA as essentially equivalent to the EEA data protection laws, for which reason additional protection is not required to export personal information to these regions. 

However, certain countries (“Third Countries”) have not received EEA authorisation (you can view the complete list via the following LINK). As a consequence, international transfers of information which are carried out to these countries must be completed using legal grounds which justify the sharing of data and must be carried out applying appropriate technical, legal and organisational measures, such as models of contractual clauses approved by the European Commission or other procedures in accordance with what is set out and permitted by the applicable legal requirements.

In relation to the international transfers MEU makes to Third Countries, for example, to one of its technology service providers, it maintains all of its guarantees, safeguarding and requirements stipulated by the Data Protection Regulation and which are necessary to maintain your privacy. Storage limits

4.5 The length of time we store your personal details depends on company needs and legal requirements. Personal details are held for the amount of time needed to complete the purposes for which they were originally collected, as well as other related approved purposes. For example, information and correspondence relating to certain transactions will be held until the date by which any requests relating to these transactions has expired or to comply with required regulations in accordance with the storage of these details. When these personal details are no longer needed, they will be made completely anonymous (in which case they will be stored and used anonymously) or they will be securely destroyed.

5.1 The user has the right to ask MEU not to use their personal information for marketing purposes.
